Wiper Party leader Kalonzo Musyoka has strongly condemned the arrest of Mukurweini MP John Kaguchia, describing it as arbitrary and raising concerns over what he termed selective application of the law.

In a statement following the MP’s arrest, Kalonzo said while he does not support incitement from any individual, every leader has a constitutional duty to uphold peace and respect the rule of law. He emphasized that Kenya’s Constitution guarantees freedom of expression and argued that the law should be enforced fairly and without political bias.

The opposition leader questioned what he described as a double standard in the enforcement of laws on alleged incitement. He claimed that previous controversial remarks by senior government officials, including statements he attributed to President William Ruto and other top UDA leaders, did not result in legal action, while opposition figures face swift arrests.

Kalonzo argued that justice should not depend on whether an individual supports the government or belongs to the opposition. He maintained that if allegations of incitement are the basis for legal action, the law should be applied equally to all, regardless of political affiliation or public office.

He concluded by warning that selective enforcement of the law undermines public confidence in the justice system and has no place in a democratic society.
