The High Court in Nairobi has temporarily halted the suspension of Moitalel Ole Kenta as Secretary-General of the Jubilee Party, allowing him to retain the position pending the inter partes hearing and determination of the case.

The interim order was issued on Monday, September 21, 2026, at the Milimani High Court in Nairobi in a case pitting the Jubilee Party of Kenya and Moitalel Ole Kenta against the Registrar of Political Parties and Ngunjiri Wambugu.

Justice J. Mulwa certified the matter as urgent and directed that the respondents be served with the application within two days.

The respondents have been given seven days after service to file and exchange their responses, while the applicants have been granted seven days to file any further affidavits together with their submissions.

The respondents will also have seven days to file and exchange their submissions after service.

The court has scheduled the matter for October 15, 2026, when the parties will return for compliance and/or highlighting of their respective submissions.

The interim orders preserve the position pending the hearing and determination of the application, temporarily putting the disputed leadership changes on hold.

The court has also warned that disobedience or failure to observe the orders could attract penal consequences.

The development comes amid an ongoing leadership dispute within Jubilee Party, with Kenta’s position as Secretary-General at the centre of the latest legal battle.
