Obado, Oyamo and Obiero Found Guilty in Sharon Otieno Murder Case

Former Migori Governor Okoth Obado, his former personal assistant Michael Oyamo and Caspal Obiero have been found guilty of the 2018 murder of university student Sharon Otieno after the High Court ruled that the prosecution had proved its case against all three accused persons.

In delivering the judgment, the court found that the three acted together as part of a common plan that ultimately led to Sharon’s death. The judge held that Obado provided the motive behind the killing, while Oyamo facilitated the execution of the plan and Obiero assisted in carrying it out. The court concluded that their actions formed a coordinated criminal enterprise that resulted in the fatal attack.

The judge further ruled that Obado’s absence from the actual scene of the murder did not absolve him of criminal responsibility. Under the principle of common intention and Section 20 of the Penal Code, the court held that all three were principal offenders because they acted in concert toward the commission of the crime, regardless of whether they were physically present at the location where Sharon was killed.

The court also found that the circumstantial evidence presented during the trial was compelling and established beyond reasonable doubt that the accused acted with malice aforethought in causing Sharon Otieno’s death. Consequently, the prosecution was found to have successfully proved the murder charge against each of the three accused persons, leading the court to find Okoth Obado, Michael Oyamo and Caspal Obiero of murder as charged.
